Terms and Conditions of Use
Last updated: 31 August 2026
1. Purpose and acceptance
These Terms and Conditions of Use govern access to and use of the HUGiiNE platform, including Mood Intelligence, mood check-ins, history, patterns, context, activity, location, weather, notifications and other features made available through the Platform.
By creating an account or using the Platform, the user confirms that they have read and accept these Terms and Conditions and have been informed about the Privacy Policy. Acceptance of these Terms does not replace any specific consent or device permission that may be legally required for particular features, such as location, activity, notifications or microphone access.
2. What HUGiiNE is
HUGiiNE is a Mood Intelligence platform designed to help users record how they feel and discover personal patterns associated with the time and context in which those check-ins occur.
Users can record their mood using a simple scale and, if they choose, add a comment or context. The Platform may combine those check-ins with information such as time, activity, location, weather, type of place and social context where that information is provided or available with the appropriate permissions. HUGiiNE uses the user’s own history to look for associations and trends over time.
3. Nature of patterns and results
HUGiiNE identifies associations in the available history. An association or correlation does not, by itself, demonstrate cause and effect.
Patterns, trends, summaries, alerts, indicators, inferences and suggestions produced by the Platform are informational and are intended to support self-understanding and observation of the user’s own history.
HUGiiNE cannot guarantee that an identified pattern is complete, permanent or causal. Information may change as new check-ins are added, and users should interpret results as signals based on the available data rather than as certainties about their future state.
4. Not a substitute for professional advice
HUGiiNE Mood Intelligence is not a medical device and does not provide medical, psychological, psychiatric or other regulated professional advice unless expressly stated otherwise under an appropriate legal framework.
Mood, activity, location, weather and context data should not be used for self-diagnosis or as a substitute for consultation with appropriately qualified professionals where there is a concern about physical or mental health, personal safety or another matter requiring professional assessment.
5. Artificial intelligence and automated analysis
HUGiiNE may use artificial intelligence systems, statistical models, algorithms and other automated mechanisms to organise information, identify associations, summarise history and explain personal patterns. Users should be aware that some analyses may be produced using automated processes.
These systems are probabilistic and may produce incomplete, inaccurate or unsuitable results for particular circumstances. Users should critically assess any interpretation or suggestion presented by the Platform.
6. Personal patterns
HUGiiNE may relate mood check-ins to their context and history to identify individual trends. These trends may include associations with times of day, activities, places, weather, social context or other available factors.
Patterns are dynamic and based on the available information. They are not an objective, clinical, definitive or immutable definition of the user’s personality, identity, ability or health. A single check-in, place or activity is not automatically converted into a stable characteristic of the user.
7. Context, location, activity and weather
Certain features may use context information provided by the user or device, including time, activity, movement, location and weather. These features depend on device capabilities, permissions granted by the user and the availability of associated technical services.
Users can withdraw or change device permissions through the operating system, app or browser settings. The absence of a permission may limit a particular context feature but should not be interpreted by HUGiiNE as a negative characteristic of the user. Wherever possible, the Platform aims to use only the information needed to contextualise check-ins and identify patterns.
8. User account and minimum age
Users are responsible for providing accurate information, maintaining control of the email address associated with their account and preventing unauthorised access. Codes and other authentication methods are personal and must not be shared with third parties.
HUGiiNE is intended exclusively for users aged 18 or over. Accounts may not be created by anyone under 18.
9. Permitted use
Users agree to use the Platform lawfully, responsibly and in accordance with these Terms.
- Do not use the Platform for illegal, fraudulent or discriminatory purposes or to harm third parties.
- Do not attempt to gain unauthorised access to accounts, systems, data or features.
- Do not interfere with the security, integrity or operation of the Platform or introduce malicious software.
- Do not use HUGiiNE patterns or inferences as a medical or psychological diagnosis or as the sole basis for high-impact decisions.
- Do not enter personal data, sensitive data, trade secrets or confidential third-party information where there is no legitimate basis or authorisation to do so.
10. Information about other people
Social context or comments associated with a check-in may mention other people. Users should limit that information to what is necessary and, where possible, use general categories such as family, friends or work instead of unnecessary personal identifiers.
HUGiiNE is not intended to build autonomous profiles of third parties from a user’s Mood check-ins. Sensitive, confidential, excessive or unlawfully obtained information about other people should not be entered.
11. Service availability and security
We aim to keep HUGiiNE available, functional and protected through appropriate technical and organisational measures, but no computer system is entirely free of risk. We do not guarantee permanent, uninterrupted or error-free operation in all circumstances. Features that depend on sensors, location, weather, operating systems or external providers may be temporarily unavailable or may return incomplete data.
12. Evolution of the Platform
HUGiiNE is an evolving system. Mood Intelligence features, methodologies, artificial intelligence models, technical providers, context types and components may be changed, added or removed. Changes that materially affect use of the Platform or the processing of personal data will be communicated where required by law.
13. Intellectual property and user content
The Platform, including its software, design, methodology, structure, trademarks, proprietary content and graphic elements, is protected by applicable intellectual property rights. Users retain any rights they hold in the content they submit and grant HUGiiNE only the permissions necessary to store, process, analyse and transform that content in order to provide the requested features, subject to the Privacy Policy.
14. Limitation of liability
To the maximum extent permitted by applicable law, HUGiiNE will not be liable for decisions made solely on the basis of patterns, associations, inferences or content produced by the Platform without appropriate evaluation by the user, or for inaccuracies in information provided by the user, the device or external context, location or weather services.
Nothing in these Terms excludes or limits consumer rights, data-protection rights or liabilities that cannot legally be excluded or limited under applicable law.
15. Suspension and closure
HUGiiNE may suspend, restrict or close access where there are security reasons, illegal or abusive use, fraud, a serious breach of these Terms or a legal obligation. Users may stop using the Service and request closure of their account, subject to any legally applicable retention periods described in the Privacy Policy.
16. Changes to these Terms
These Terms may be updated to reflect legal, technical or functional changes to HUGiiNE Mood Intelligence. Where a change is materially significant, users will be appropriately informed and, where necessary, renewed acceptance will be requested before continued use of the Service.
17. Applicable law
These Terms are governed by Portuguese law and applicable European Union law, without prejudice to mandatory consumer-protection, data-protection or other provisions that may legally apply to the user based on their place of residence or the specific circumstances.
18. Contact
Questions relating to these Terms may be submitted through the contact methods made available by HUGiiNE. Questions concerning the processing of personal data, the exercise of rights or privacy should be submitted through the contact details specified in the Privacy Policy.
